Fraudulent Statements on Tax Returns in Federal Court
Tax fraud is a federal crime that brings with it serious consequences. With the IRS’s audit computers, fraudulent tax documents are almost always flagged for review. While it may be possible to get away with low-dollar tax evasion for a time, most people will eventually be caught. If the IRS is charging you with high-dollar tax fraud, it’s important to hire an attorney.
Keeping in mind that the IRS is not in business to blatantly “get” responsible taxpayers, the following provides some insight into what you should know about making a false statement on a tax return.
What the IRS Must Prove
To convict a person of tax fraud, the IRS must prove that there was willful intent behind a failure to pay a portion of one’s taxes. What this boils down to is that you have been purposely dishonest when filing your tax forms and/or related documentation. This may include:
- Tax statements that have been readily presented with missing income data
- Income forms that have been tampered with to present inaccurate information
False Filings: What Happens
Initially, the IRS obtains tax records prior to dispatching a notice that they have a concern. Contained within is a request that you immediately address any problems and pay what you rightfully owe. In smaller cases—those dealing with amounts less than $100,000—refusal to do so usually results in a formal investigation.
If the amount you’re dealing with is in excess of $100,000, it’s time to hire a criminal defense attorney in Albuquerque. In these situations, IRS agents will most likely show up at your home or office to ask you some questions.
If this happens, be polite and respond to the agents by saying that you would prefer not to answer any questions until you retain an attorney. Remember, you’re dealing with a government entity that has more insight and knowledge than you may think, and if you make any statements prior to hiring an attorney, they can be viewed as admissions of illegal activity.
